Akron Woman Charged with Death of 13 Month Old

An Akron woman stands charged with once count of reckless homicide and one count of child endangering after allegedly leaving the 13-month-old girl in her care inside a parked vehicle on a 90-degree day. Lisa Scott, 42, an Akron child care provider, is accused of leaving Aolani McCray inside an SUV for several hours on Sept. 2, 2011. McCray was found unresponsive at approximately 2 p.m. and later died at Akron Children’s Hospital.

Scott was booked into the Summit County Jail after her court appearance but later posted 10 percent of a $25,000 bond set by visiting Akron Municipal Court Judge Michael McNulty.

Section 2903.1041 of the Ohio Revised Code defines “reckless homicide” as recklessly causing “the death of another or the unlawful termination of another’s pregnancy.” Reckless homicide is a felony of the third degree and, if convicted, Scott could face up to five years in prison and a $10,000 fine.

Section 2903.1041 of the Ohio Revised Code, entitled “Endangering Children”, states:

No person, who is the parent, guardian, custodian, person having custody or control, or person in loco parentis of a child under eighteen years of age or a mentally or physically handicapped child under twenty-one years of age, shall create a substantial risk to the health or safety of the child, by violating a duty of care, protection, or support.

Child endangerment is also felony of the third degree carrying the same maximum five year prison sentence and $10,000 fine as reckless homicide.
