After the passage of Issue 2 in November 2023, it is now legal for adults aged 21 and older in Ohio to smoke recreational marijuana in private places. However, it will be a while before adults can walk into a dispensary and buy marijuana if they do not have a medical marijuana card.
That’s because no one in Ohio can legally sell recreational marijuana until the state Department of Commerce finalizes regulations and licensing requirements for recreational sales. Furthermore, state legislators are still considering changes to the law, and those changes may delay the process of finalizing regulations for dispensaries.

Can You Smoke Marijuana in Ohio Without a Medical Card?
While adults in Ohio cannot yet purchase marijuana from dispensaries without a medical card, they can smoke it in private without worrying about going to jail. Issue 2 allows adults to consume marijuana at home, but not in public places. The law allows adults to possess up to 2.5 ounces of marijuana without legal repercussions. Adults can grow up to six marijuana plants at home, or up to 12 plants in households with two or more adults.
Can You Legally Buy Marijuana Seeds in Ohio?
Not yet. The Department of Commerce still needs to finalize rules for the sale and delivery of marijuana seeds, including whether to allow online sales.
Can You Grow Marijuana in Your Yard?
No. You have to keep any marijuana plants you grow in a locked, enclosed area that’s not accessible to children or visible to the general public.
How Long Before the Department of Commerce Finishes Finalizing Recreational Marijuana Regulations?
Issue 2 requires the state to finish the rules for recreational marijuana sales and licensing for dispensaries within nine months. So, theoretically, recreational sales should start by the end of 2024. However, any changes legislators make to the law could disrupt this process and cause additional delays.
Can Lawmakers Repeal Issue 2?
No. The governor may veto bills from the state legislature but cannot repeal laws passed by popular vote. However, lawmakers may make changes to the law and are considering some tweaks. Keep up with local news sources to learn more about any changes to Issue 2.
What About Federal Drug Laws?
It is still illegal at the federal level to transport marijuana or marijuana seeds across state lines. In the meantime, only registered patients or caregivers with the Ohio Medical Marijuana Control Program can buy from dispensaries.
