Have you been arrested for operating a vehicle while impaired in Akron, Ohio? Driving under the influence is a serious offense in Ohio and your driver’s license could be at risk of suspension. Under Ohio State traffic law, operating a motor vehicle while under the influence does not necessarily have to mean that you were driving and it could be in reference to more than just an ordinary motor vehicle. If you are stopped by a police officer and they have reason to believe that you are under the influence, they will conduct several standard field sobriety tests or ask you to submit to a chemical test in order to determine your blood alcohol content (BAC) level. Remember that if you are found driving with a BAC level of .08 or higher, then you can be charged with OVI/DUI.

If you refuse to submit to a blood, breath or urine test when the law enforcement officials ask you, your penalties could be significantly increased. This is because Ohio has an Implied Consent Law in the Revised Code Section 4511.191, which states that you must consent to a chemical test upon arrest if law enforcement has reason to believe you are intoxicated. The penalties for refusing a chemical test are as follows:

  • 3 three days – 6 months in jail
  • A fine anywhere from $375-$1,075
  • Required Drivers’ intervention program which lasts for 3 days
  • Driver’s license suspension for 6 months up to three years
  • You must install an ignition interlock device in your vehicle
